Welcome to Pagevista.io, operated by Served.ch LLC ("Company," "we," "our," or "us"). By accessing or using Pagevista.io (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you may not use the Service.

1. Definitions

  • Service: The Pagevista.io analytics platform, including all related software, APIs, features, and content.
  • User: Any individual or entity that accesses or uses the Service.
  • Customer: A business or entity that subscribes to and uses the Pagevista.io analytics platform.
  • End User: An individual who visits or interacts with a Customer’s website or application where the Pagevista tracking script is embedded.
  • Subscription: A paid plan providing access to specific features or extended data retention.
  • Content: Any data, text, or materials uploaded or transmitted via the Service.

2. Description of Service

Pagevista.io is a privacy-focused analytics platform that enables businesses to monitor and analyze visitor activity on their websites and applications. The Service records session metrics such as page visits, referrers, countries, devices, browsers, and session duration. It provides aggregated insights and dashboards to help customers understand user engagement and performance without storing personally identifiable information.

Customers can use the Service to:

  • Track anonymous session and event data on their websites or applications.
  • Access aggregated analytics reports and visualizations.
  • Manage their workspace, users, and subscription settings within the app.pagevista.io dashboard.

3. Eligibility & Account Registration

  • Eligibility: You must be at least 18 years old to use the Service.
  • Account Registration: Certain features require creating an account with accurate and up-to-date information.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials.
  • Account Suspension: We may suspend or terminate accounts that violate these Terms, security policies, or applicable laws.

4. Subscription & Payments

  • Free Plan: Pagevista.io offers a free plan with limited features and data retention (currently 3 months).
  • Paid Plans: Certain advanced features or longer data retention periods may require a paid subscription managed via Stripe.
  • Billing: Subscriptions renew automatically unless canceled before the renewal date.
  • Refunds: Payments are non-refundable except as required by law.
  • Non-Payment: Failure to pay may result in suspension or termination of the account.

5. User Responsibilities

  • Compliance: You must comply with all applicable laws and regulations, including data protection laws (e.g., GDPR).
  • Implementation: You are responsible for correctly implementing the Pagevista script on your own site or application.
  • Transparency: If you use Pagevista with features that do not identify or link users across sessions, user notification is not legally required, as no personal data is processed. However, if you enable features that allow tracking or association of sessions over time, you must inform your visitors and reflect this in your own Privacy Policy.
  • Prohibited Use: You may not use the Service to collect or process personal data in violation of applicable privacy laws, or to build user profiles across unrelated websites or customers. Tracking users within your own domains or subdomains is permitted when performed in compliance with applicable data protection regulations.
  • Security: You are responsible for maintaining the security of your credentials and integrations.

6. Privacy & Data Processing

  • Use of the Service is subject to our Privacy Policy and Data Processing Agreement (DPA).
  • We process visitor analytics data solely on behalf of our customers as their Data Processor under GDPR.
  • By using the Service, you confirm that you have a lawful basis for processing and that you comply with all applicable data protection obligations.
  • You must ensure that appropriate disclosures and consents (where required) are in place for your end users.

7. Service Availability & Changes

  • We strive to provide reliable and continuous operation of the Service but do not guarantee uninterrupted availability.
  • Scheduled maintenance or external outages may cause temporary downtime.
  • We may modify, suspend, or discontinue the Service or specific features with reasonable notice when feasible.

8. Termination of Accounts

  • We may suspend or terminate your account for violations of these Terms or applicable law.
  • Upon termination, your access to the Service may be revoked and all data deleted in accordance with our Privacy Policy.
  • You may cancel your account at any time. Fees already paid are non-refundable, but the Service remains available until the end of the billing period.
  • We will attempt to notify you of suspensions or terminations and provide a reason unless prohibited by law or security concerns.

9. Limitation of Liability & Disclaimers

  • The Service is provided “as is” without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, or consequential damages resulting from use or inability to use the Service.
  • We make no guarantee that analytics data or results will meet your expectations or business objectives.

10. Early Access / Beta Disclaimer

  • Pagevista.io is currently offered in an early access (beta) phase.
  • Features, interfaces, and functionality may change without prior notice.
  • During beta, data loss or temporary service interruptions may occur.
  • We do not guarantee preservation or recovery of data collected during this phase.

11. Intellectual Property

  • All intellectual property rights in the Service, software, and branding remain the property of Served.ch LLC.
  • Customers retain ownership of their own content and analytics data.
  • Customers grant us a limited license to process and store data as required to provide the Service.
  • You may not copy, modify, distribute, or reverse-engineer any part of the Service without explicit permission.

12. Governing Law & Dispute Resolution

  • These Terms are governed by applicable Swiss law.
  • Any disputes shall be resolved through arbitration or a competent court in Basel City Switzerland.

13. Changes to Terms

  • We may update these Terms from time to time to reflect service or legal changes.
  • We will notify users of significant changes. Continued use of the Service after updates constitutes acceptance of the revised Terms.
